This website and the NONSEEN store are operated by VYAQ, Inc. under the NONSEEN brand.
These Terms govern access to the NONSEEN EN website and purchases made through it.
“NONSEEN,” “we,” “us,” or “our” means VYAQ, Inc. doing business as NONSEEN.

2. Eligibility and accounts
You must be legally capable of entering a binding contract in your location. If you create an account, you are responsible for the accuracy of the information provided and for safeguarding access credentials.
Guest checkout may be available. Account creation does not alter any mandatory consumer right.
3. Products and product information
We aim to describe products accurately, including materials, ingredients, sizes, shades, images, care, and availability. Display settings and production variations can affect how color or texture appears.
Product availability, packaging, and details may change. We may correct errors before accepting an order.
4. Prices, currency, taxes, and duties
Prices on the EN storefront are displayed in USD unless expressly stated otherwise.
Shipping, taxes, duties, and discounts are shown or explained before payment where available. U.S. orders are shipped Delivered Duty Paid (DDP), with import duties and applicable import taxes included; sales tax is calculated at checkout where required. For destinations outside the United States and South Korea, the recipient is responsible for import duties, taxes, brokerage fees, and local authority charges unless explicitly shown at checkout. South Korea is excluded from the EN/global storefront shipping destinations.
5. Orders and acceptance
Submitting an order is an offer to purchase. An automated acknowledgment does not necessarily mean the order has been accepted.
We may decline or cancel an order for legitimate reasons, including inventory errors, suspected fraud, payment failure, legal restrictions, pricing errors, or inability to ship to the destination. If payment has been captured for an order we cancel, we will initiate an appropriate refund.
6. Payment
Available payment methods are displayed at checkout. Payment services are provided by Stripe or another provider identified at checkout.
Charges from our store will appear as NONSEEN on the customer’s card or bank statement.
Customers represent that they are authorized to use the selected payment method. We do not ask customers to send full card numbers by email or contact form.
7. Shipping and delivery
The Shipping Policy forms part of these Terms. Processing and delivery estimates are not guarantees unless required by law.
8. Returns, cancellations, and refunds
The Returns, Exchanges, Cancellations & Refunds Policy forms part of these Terms.
Nothing in these Terms limits a non-waivable consumer right.
9. Promotions
Any promotion, discount, gift, or limited offer is subject to the terms displayed with that offer. We may correct or cancel a promotion affected by error, abuse, or fraud, subject to applicable law.
No recurring charge, subscription, negative option, or trial applies unless clearly disclosed and affirmatively accepted.
10. Intellectual property
The site and its original content, trademarks, product names, designs, images, graphics, and software are owned by or licensed to VYAQ, Inc. / NONSEEN and protected by applicable law.
Use of the site does not transfer intellectual-property rights. Unauthorized copying, resale of content, or use of trademarks is prohibited.

Users may not interfere with the site, attempt unauthorized access, submit false information, engage in fraud, introduce malicious code, scrape the site in a harmful manner, or violate another person’s rights.

To the maximum extent permitted by law, the site and content are provided without warranties not expressly stated in these Terms.
Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded.
14. Limitation of liability
To the maximum extent permitted by applicable law, NONSEEN is not liable for indirect, incidental, or consequential loss arising from use of the site or products.
This limitation does not apply where liability cannot be limited by law.
15. Indemnity
To the extent permitted by law, customers are responsible for losses caused by their unlawful misuse of the site or violation of another person’s rights.
16. Governing law and disputes
These Terms are governed by the laws of the State of Delaware and applicable federal laws of the United States, without limiting any mandatory consumer rights that apply in the customer’s jurisdiction, and without regard to conflict-of-law rules that would require a different result.
These Terms do not limit mandatory consumer protections or jurisdictional rights that apply in a customer’s location.
17. Changes
We may update these Terms. The effective date and last-updated date will be shown at the top of the page. Changes do not retroactively reduce rights already attached to an accepted order unless permitted by law.
